She enjoys playing in her sandbox and shows remarkable intelligence for her age, despite not being able to communicate with people older than herself. Authorities ruled it a murder-suicide.The Bagbys were enraged and set out to change Canada’s bail laws.David Bagby’s book, “Dance with the Devil,” which recounted the murders, was published in 2007.Kuenne, who had set aside his film after Zachary’s death, committed to finishing it and working with the Bagbys.“I had to put this film out publicly and as a call for change and a companion to the book,” Kuenne explained in a trailer that was released with the film.Kuenne and the Bagbys screened “Dear Zachary” at festivals across Canada.
After the shooting, according to Kate, Turner called her claiming she was trying to reach Andrew.Still grieving the death of their son, the Bagbys moved to Newfoundland and fought for custody of Zachary.“We thought of him as a hostage,” said David.They had to be nice to Turner, to keep her mellow, and not fight with her.“We couldn’t actually believe she’d (harm Zachary), but we consciously feared she could do that,” he said.“It’s heartbreaking,” said Kate, who recalls last seeing Zachary the evening before he was killed.The memory of that visit is of a crying Zachary being taken away from them. He was right where he wanted to be. Zachary’s mother, Newfoundland native Dr. David and Kate Bagby endured, however, and set out on a quest to change the Canadian laws that allowed Shirley Turner, a convicted murderer, out on bail. In a 2006 report, Winnipeg medical examiner Peter Markesteyn — after an inquiry into Zachary's death — harshly criticized the Child, Youth and Family Services and the Office of the Child and Youth Advocate, and concluded that Zachary should never have been in the care of his mother.In 2010, Bill C-464 added a clause to the Criminal Code of Canada allowing bail to be denied if deemed necessary to protect a child, a change spurred by the Bagbys.David Bagby wrote a book, “Dance With the Devil: A Memoir of Murder and Loss,” in 2007; a documentary film, “Dear Zachary: A Letter to a Son About his Father” was made by Andrew’s longtime friend Kurt Kuenne in 2008, with the Bagbys’ participation.David Bagby wouldn’t mind a trip back to Newfoundland, but said his wife has more emotions about the subject and they likely won’t return.They’ve had the conversation over the years about how they feel about the place where they made good friends, but that is tied forever to their family tragedy.But had Andrew not gone to medical school here and therefore never laid eyes on Turner, there are no guarantees he might have escaped his fate, Bagby said.“Some other equivalent (to Shirley Turner) could have been anywhere Andrew went,” he said, allowing what happened had nothing to do with Newfoundland as a place.1 being least likely, and 10 being most likely. She was fighting extradition to the United States when she gave birth.The Bagbys quickly traveled to Newfoundland to care for the sunny toddler who had Andrew’s smile.Had Turner been arrested in Pennsylvania, where Andrew’s murder occurred, she could have been held without bail, pending trial.
